Aapni service.com constitute a technology platform that enables you, as a user of Aapni service.com and schedule web-based services with independent third party service providers who have an agreement with Aapni service.com or its affiliates and facilitate payments to Third Party service Providers for the services and receive receipts for those payments.

The Services are being provided solely for your use, unless Aapni service.com has agreed with you otherwise in a separate agreement. You acknowledge that Aapni service.com not providing ‘the services’. Aapni service.com has contacted with the third party contractors to provide these services on case to case basis, all these contractor are not employees of Aapni service.com or our affiliates. Aapni service.com accepts liability for the Aapni service.com Platform that provides to you subject to these Terms.

Third Party Providers are responsible for the services provided to you.

• License.
  Subject to acceptance of these Terms, Aapni service.com grants you a limited, non-exclusive, non-revocable license to access and use the Aapni service.com web-based plateform on your personnel device for The services, access to use any content, information and related materials to the services solely for your use.

Rights which are not expressed here granted herein are reserved by Aapni service.com licensors.

• Provision of the Services.
  You knowledge that the Services may be made available under aapni service.com is being provided by third party contactors for various brands or request.
• Third Party Services and Content.
  You knowledge that Aapni service.com does not control the ‘The Services’ and content provided by third party. Aapni service.com not liable for the product/spare part is being used for your service by third party, you are solely responsible to check the product is being used for the service by third party contractor.
• Ownership
  The services and all rights therein are shall remain the property of aapni service.com and its licensors. Neither the Terms nor use of services grant or convey to you any rights related to services except for the limited license granted above. To use or reference company name, Logo, product and service names, trademarks or services is only for aapni service.com

• THE SERVICES USER ACCOUNTS.
  To use the services of aapni service.com, you must register yourself on aapni service.com platform, your age must be of legal majority in your jurisdiction, to create an account you need to provide personnel information ie, your name, complete address, mobile number and one valid payment method (either UPI, credit card/debit card, net banking or UPI etc.)

  You agree to enter correct payment method, if it is found to be invalid it is result inability to access or use the services. You are fully responsible for all activity that occurs in your Account, and you maintain the security and secrecy of your Account username and password at all times, aapni service.com does not have any liability towards your account.

• User Requirements and Conduct
  Services are not for the use of minor user. You will not authorize third party to use your account and also not allow minor to use your device to use aapni service.com services, also not permit a minor to receive third party services unless accompanied by you. You agree to comply all applicable laws when accessing or using the services of aapni service.com. you agree that you will not cause annoyance, inconvenience, nuisance, or damage of property whether to third party or affiliates. You may ask to provide identity of the third party service provider and vice versa, you may be asked to prove your identity to access the Services, and agree that you may be denied access to or use of the Services on denied to provide identity proof.
• Text Messaging.
  As text message (SMS) is the part of the business to register your account and provide you the details of services in this course You agree to receive text message (SMS) to use the Services. If you don’t desire, you may opt-out of receiving the text messages at any time from aapniservice.com at any time about your decision to stop the text messages. You acknowledge that opting of not receiving the SMS may impact your use of the Services.
• Network Access and Devices.

• PAYMENT
  You agree to pay the conveyance fee and applicable taxes as per law to aapnisedrvice.com/ SBS foresight pvt. Ltd. for use of its web-based platform and its third party linkages at the time of booking of service or upon completion of the service through online mode only, this fee is non-refundable, these may be refundable if there is major failure in service and after you receive services through aapniservive.com platform aapniservice.com will facilitate your payment of the applicable Service Charges on behalf of The Third party service provider.
  Payment of service charges may be made directly to Third party Provider after mentioning in the application. You agree to pay the services charges and Fee needs immediately after completion of service and payment will be facilitated by aapniservice.com using the preferred payment method designated to your account and a receipt will be send through text message and to your email. You may pay the service charges in cash to third party after mentioning in the application, if your online payment method is not working.

  Further, It is clarified that the Service Charges and Fees along-with applicable taxes shall be made only for the services provided by the Third Party Provider to you and for the Services provided by Aapniservice.com.Aapniservice.com is does not promoting any tip or gratuity to the third party service provider.

• DISCLAIMER.
  Except as required of aapniservice.com under the consumer guarantees, the services are provided “as is” and “as available.” Aapniservice.com disclaims all representations and warranties, express, implied or statutory, not expressly set out in these terms, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, and makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of the services or any services requested through the use of the services, or that the services will be uninterrupted or error-free. Aapniservice.com does not guarantee the quality, suitability, safety or ability of third party providers.

  You agree that the entire risk arising out of your use of the services, and any service or good requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law, including the relevant consumer law legislation.

• LIMITATION OF LIABILITY.
  if you are acquiring the services as a consumer, aapniservice.com’s liability for a failure to comply with a consumer guarantee is limited to in the case of services supplied to you as part of the services under this agreement, the supply of the relevant services again, or the payment of the cost of resupplying the services with, or otherwise resulting from any use of the services, even if aapniservice.com has been advised of the possibility of such damages. aapniservice.com shall not be liable for any damages, liability or losses arising out of: (i) your use of or reliance on the services or your inability to access or use the services; or (ii) any transaction or relationship between you and any third party provider, even if aapniservice.com has been advised of the possibility of such damages. aapniservice.com shall not be liable for delay or failure in performance resulting from causes beyond aapniservice.com’s reasonable control.
  aapniservice.com’s services may be used by you to request and schedule services with third party providers, but you agree that aapniservice.com has no responsibility or liability to you related to any services provided to you by third party providers other than as expressly set forth in these terms. aapniservice.com will maintain a complaints management framework, and will manage this framework on behalf of third party providers, in a reasonable way and in accordance with the non-excludable requirements of the relevant consumer law
• LEGISLATION.
  notwithstanding anything contained in these terms, aapniservice.com will not be deemed to be in default or be responsible for delays or failures in performance resulting from acts beyond the reasonable control of aapniservice.com. such acts shall include but not be limited to acts of god, riots, acts of war, epidemics, pandemics, trade embargoes, fire, typhoons, earthquakes, other natural disasters. etc. the limitations and disclaimer in this section, do not purport to limit liability or alter your rights as a consumer that cannot be excluded under applicable law, including any of the non-excludable requirements of the relevant consumer law legislation.
• GOVERNING LAW; ARBITRATION.
  There are a number of mechanisms available to you to resolve any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the Services or these Terms, including those relating to its validity, its construction or its enforceability or with the services provided by a Third Party Provider (any “Dispute”). Aapniservice.com or its affiliates operate a complaints process to allow you to make complaints about Aapniservice.com or Third Party Providers, and Aapniservice.com or its affiliates also manage refunds to you in relation to those complaints. Aapniservice.com or its affiliates will operate this complaints process in a reasonable manner. You agree and acknowledge that you must raise any Dispute with the Services or the services provided by a Third Party Provider as soon as is practicable, but no later than 48 hours from the time the Dispute arises. If you fail to raise a Dispute within 48 hours from the initial occurrence of such Dispute, Aapniservice.com shall be under no obligation to resolve such Dispute. If a Dispute is reported more than 48 hours after the initial occurrence of the Dispute Aapniservice.com shall in its sole discretion choose whether or not to attempt resolution of the Dispute.
  In addition, you may have rights to make a complaint to fair trading or consumer law bodies in relation to applicable consumer laws, including the non- excludable portions of the relevant Consumer Law legislation. If any dispute arises between the parties hereto during the subsistence or thereafter, in connection with or arising out of this Agreement, the dispute shall be referred to Arbitration under Arbitration and Conciliation Act, 1996 by a sole Arbitrator. Arbitration shall be held in New Delhi. The proceedings of Arbitration shall be in the English language. The Arbitrator’s award shall be final and binding on the parties and the agreement shall be subject to the exclusive Jurisdiction of the Court at New Delhi.
